That Cabinet:

 

 1. Discharged the existing PSPO, at Appendix A, with effect from 4 March 2026.

 

 2. Considered the consultation responses appended to this report and agreed the statutory conditions for a PSPO, as detailed in legal implications section of this report, are satisfied.

 

 3. Approved the introduction of the new Public Space Protection Order (PSPO) at Appendix N, covering the areas shown in Schedule 1 at Appendix L, to commence for 3 years from and including 4 March 2026.

 

 4. Authorised Police Constables, including PCSOs, to issue Fixed Penalty Notices (FPNs) on behalf of East Suffolk Council.

Reason for Decision
The purpose of this report is to seek Cabinet approval to discharge the existing Lowestoft Harbour Public Spaces Protection Order (PSPO) and to approve a new PSPO covering Lowestoft town centre and surrounding areas. The proposed PSPO introduces updated and additional conditions to address persistent and recurring anti-social behaviour (ASB) and public nuisance that continue to have a detrimental effect on the quality of life of residents, businesses and visitors.
Alternative Options Considered and Rejected

Option 1 – Vary the existing PSPO (expires October 2026): provides short-term controls but limited certainty and requires further review within a short timeframe and doesn’t include revised conditions (Appendix A).

 

Option 2 – Discharge and replace with a new PSPO: provides long-term certainty, refreshed conditions based on evidence, and a clear enforcement framework (Appendix N).
