That Cabinet:

1. Approved the adoption of the revised Allocations Policy as set out in Appendix A to ensure that the Council’s housing allocation framework is legally complaint, fair, and fit for purpose.

2. Authorised the Head of Housing in consultation with the Cabinet Member for Housing to make any presentational or clarificatory improvements or minor non material amendments as necessary prior to its publication.

Reason for Decision

To ensure that the Allocations Policy is legally compliant with current legislation, including the Housing Act 1996 (as amended), the Domestic Abuse Act 2021, and statutory guidance. This will reduce the risk of legal challenge and ensure the Council meets its statutory duties.

 

The revised policy will ensure a fair, consistent, and transparent process across all Gateway local authorities. This will improve operational efficiency, reduce complaints and appeals, and support equitable access to housing.

 

To strengthen the policy’s ability to meet the needs of vulnerable applicants, including those experiencing homelessness, domestic abuse, or complex health needs—thereby supporting the Council’s Public Sector Equality Duty.

 

To align the policy with current strategic priorities, including the Homelessness and Rough Sleeping Strategy 2025-30, and to support effective partnership working with registered providers and other stakeholders.

Alternative Options Considered and Rejected

Option 1 - Do nothing. This will put the Council at risk of legal challenge and breach of statutory requirements. If the policy changes are not approved this will have an impact on vulnerable client groups such Armed Forces personnel, care leavers, or victims of domestic abuse—it may be deemed unlawful, exposing the authority to judicial review or legal challenge.

 

Option 2 – To approve the revised Allocations Policy. In doing so the Council will be legally compliant with current legislation, case law, and statutory guidance. This will reduce the risk of legal challenge and ensure the Council meets its statutory obligations.
